Is WSIB law the same as personal injury law?

No. WSIB law only covers injuries that happens at the workplace or as a result of conducting employment duties. It is separate from personal injury law and if you have been injured your claim must fall within one of these areas of law but not both.

What types of workplace injuries are covered by WSIB law?

WSIB law will apply to any workplace injury. This includes more common injuries such as slip and falls, items falling on you or machinery/equipment injuries- but it is not limited to these areas. Any injury, as long as it happened at work or while you performing your work duties, can be WSIB eligible. This can include chronic or long term health effects, such as asbestos exposure or chronic diseases/conditions resulting from repeated wear and tear on your body. If you are not sure whether your injury is covered, an experienced WSIB lawyer will be able to advise you on what options you have for that type of injury.

How much money will I get?

The size of your benefit entitlement will depend on the circumstances of each case, such as the type and severity of injury, the type of job you have (and risk of re-injury), and the advice of the treating doctor. An experienced WSIB lawyer will be able to give you an estimate of the size of your claim.

Can a lawyer help me even if I’m still getting WSIB payments?

Yes- if you suspect your benefits will soon be terminated before you are ready to return to work, a WSIB lawyer can assist you. They can also assist if your claim was granted but you feel the benefits are less than what you should be entitled to based on your injury.

Where are WSIB hearings held?

All WSIB hearings take place in Toronto, regardless of what city you live in or what city you work in.
